“Everyone has the right to a nationality”

Rottmann v. Friestaat Bayern

The Court is asked to rule on the compatibility with EU law of a decision to withdraw a nationality acquired by fraud, with the result that the applicant would be left stateless and no longer enjoy European Union Citizenship. The Court establishes that deprivation of nationality because of an act of deception cannot be considered arbitrary, but that the decision to withdraw nationality must observe the principle of proportionality and take into account the impact on the person’s rights and entitlements.
