Joint Submission on deprivation of nationality at the 41st Session of the Universal Periodic Review – Netherlands


In addition to a submission with other civil society actors on wider issues that stateless people face in the Netherlands, ENS and the Institute on Statelessness and Inclusion (ISI) have also made a thematic submission to the Universal Periodic Review focusing on deprivation of nationality in the Netherlands in a national security context – where nationality has been instrumentalised with a view to countering terrorism.

The submission reflects an increasing trend in the use of deprivation of nationality as a counter-terrorism measure, and reflects our concerns in relation to three key areas:

  • The prohibition of discrimination in relation to nationality deprivation measures;
  • The prohibition of arbitrary deprivation of nationality;
  • The prohibition against torture and cruel, inhuman or degrading treatment or punishment and the prevention of childhood statelessness in relation to nationality deprivation measures.

In line with our #StatelessnessINDEX Thematic Briefing, which provided an analysis of the issue across Europe and suggested key actions for European states, we also made specific recommendations to the Netherlands on how to prevent statelessness in nationality deprivation.
